Misdemeanors

Misdemeanors are crimes that carry less than a year in jail.  North Carolina recognizes 3 classes of misdemeanors.  There is a special class of misdemeanor that is called an A-1 which has been recently created to recognize certain misdemeanors as more serious because of certain enhancements in the conduct.  For example, a Simple Assault would be a Class 2 misdemeanor whereas an Assault on a Female is an A-1 misdemeanor.

       

Most misdemeanors carry punishments that range from 0-150 days in jail.  Being charged with a misdemeanor should be taken seriously.  A conviction for a misdemeanor can have dramatic effects on your ability to get a job or to remain employed if you already have a job.  In many cases, misdemeanor charges can be resolved without a criminal conviction.  There are deferral programs available to first time offenders as well as opportunities for parties to mediate their disputes. 

     

Misdemeanor charges all originate in District Court.  Most of the time, the charge will be resolved there.  Having a qualified attorney to represent you in District Court is very important.  The process can be confusing and if you do not understand the terminology, you may be signing yourself up for a conviction.  Misdemeanor consultations are free at our firm.  We will advise you as to the best way to handle your case and what opportunities you may have to avoid a conviction.
